Fontana Common Areas Committee Charter

The Common Areas Committee is a standing committee under the authority of the Fontana Owners' Association Incorporated (FOAI).
Purpose
The Common Areas Committee has been established by the Board of Directors of FOAI to identify and categorize Common areas within Fontana as well as develop standards for the maintenance and operation of such areas.
Definition
"Common Area" shall refer to the property described in Article 1 - Definitions, Section 5 page 2 in the Declaration of Covenants, Conditions, Restrictions and Easements. For the purposes of this committee, the recreation facilities such as the pool and clubhouse (excluding the grounds) will be considered under a separate committee and will not apply here.
"Common Area" shall mean and refer to all real property which is deeded or leased to the Association and designated in said deed or lease as "Common Area". The term shall also include any personal property acquired or leased by the Association if said property is designated a "Common Area". All Common Area is to be devoted to and intended for the common use and enjoyment of the Members of the Association, their guests and, to the extent permitted by the Board of Directors, visiting members of the general public, subject to fee schedules and operating rules adopted by the Association. All real property intended to be Common Area may be designated on subdivision plats as "Common Area", "Open Space", "Recreation Center Lot" and may include other property as may be subsequently designated for such use by the Declarant. Organization
- Common area committee membership shall consist of 3 - 7 members appointed by the Board of FOAI.
- Committee membership to consist of at least one representative Board member.
- A committee member must be a member of the FOAI, be willing to abide by all terms and conditions of the committee charter, have no limiting special interest when seeking membership, be intelligent, mature with a positive attitude and be available for work and have an interest in participating. Volunteers with relevant gardening or landscaping experience and interest are invited.
- Committee membership open to non FOAI members such as guests, advisors or experts as approved by the Board of FOAI.
Duties and Responsibilities
- The FOAI Association shall maintain but is not obliged to make improvements to all identified Common Areas as per the Bylaws of Fontana Owners Association, Inc in Article VII - Property, Section 7:05 - Maintenance and Improvements page 11.
- Prepare and submit, for approval to the Board of Directors, annual plans and budget for the operation and maintenance of identified common areas.
- Implement maintenance schedule as per identified and categorized common areas within Fontana.
- Provide, maintain and replace as necessary within the Common Areas the following: Association or Declarant installed signs, entrance fencing, walkways, lighting, landscaping, trees and sprinkler systems, if any, at the entrance of Fontana. This includes directional, section and street signs installed by the Declarant of the Association as deemed appropriate by the Board of Directors (Declaration of Covenants, Conditions, Restrictions and Easements - Article VII - Section 1 - Ownership and Maintenance of Properties (f) page 17).
- Execute and maintain in effect such maintenance bonds as may be required by governmental agencies (Declaration of Covenants, Conditions, Restrictions and Easements - Article VII - Section 1 - Ownership and Maintenance of Properties (f) page 17).
- Maintain, repair and replace all Common Area storm water detention or runoff control facilities and Storm Detention Ponds not publically owned. In particular, undertake all duties and responsibilities of the Landowner set forth in any document entitled "Stormwater Managment/BMP Facilities Mantainenance Agreement" (Declaration of Covenants, Conditions, Restrictions and Easements - Article VII - Seciton 1 - Ownership and Maintenance of Properties (c), page 17).
- Provide regular and thorough maintenance, repair, replacement and clean-up of all streets, cul-de-sac islands, sidewalk, entrance and entrance landscaping, neighborhood and subdivision signs, pedestrian paths, tennis court, clubhouse and pool grounds. (Declaration of Covenants, Conditions, Restrictions and Easements - Article VII - Seciton 1 - Ownership and Maintenance of Properties (g), page 17).
- Maintain, mow, trim, repair, and replace grass, landscaping shrubs, trees, fencing, plants, sprinkler systems, subdivision signs and other improvements located within the area of the front entrance designated 'new sign easement' (Declaration of Covenants, Conditions, Restrictions and Easements - Article VII - Seciton 1 - Ownership and Maintenance of Properties (h), page 17).
- Conduct random inspections, no less than quarterly, of all common areas.
- Provide Board of Directors with periodic progress reports on management of common area plans authorized by the FOAI Board, as well as need for unbudgeted repairs.
- For work requiring contractor performance, secure a minimum of 3 bids and make a recommendation for the award to the FOAI Board of Directors. Monitor contractor performance and evaluate contractor invoice for conformance prior to submittal to the Treasurer for payment.
- Submit a brief annual summary report in preparation for the Annual FOAI meeting.
